What this Agreement Covers
This Agreement governs your use of the Site and the Monstees Custom Printing service (the “Service”). The Service permits customers that have an appropriate relationship either with: (i) institutions of higher learning, fraternal organizations, honour societies and other collegiate groups (collectively, “Institutions”); (ii) corporations and small businesses; (iii) elementary and secondary schools; or (iv) other organizations, to design and purchase custom merchandise properly describing that relationship. You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.

Intellectual Property Rights of Monstees Custom Printing and Third Parties

Monstees Custom Printing is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs and written and other materials that appear on the Monstees Custom Printing Site (collectively the “Contents”) are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by Monstees Custom Printing.

Monstees Custom Printing is the owner of the Monstees Custom Printing trademark; other trademarks made available through this Site, including logos, slogans, colour schemes and design trademarks, are licensed for use by Monstees Custom Printing from Institutions and other third parties (the “Licensed Marks”). By using the Monstees Custom Printing Site, you agree to limit your use of Licensed Marks to uses that are directly related to such third parties and to comply with any restrictions or conditions imposed on the use and access of the Licensed Marks by the third parties. Monstees Custom Printing will notify you of such terms if your usage is in violation of such terms.

Additionally, Monstees Custom Printing has the sole discretion to reject any order that it considers libellous, defamatory, obscene, profane (according to standards established by Australian law), portraying irresponsible use of alcohol or other substances, advocating persecution based on gender, age, race, disability or national origin, containing explicit sexual content or is otherwise inappropriate for Monstees Custom Printing production.

You agree to not use Monstees Custom Printing’s Service to create any material that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable, or that infringes on any patent, trademark, trade secret, copyright or other proprietary rights of any third party.

Payment Policies

All pricing on monstees.com.au is in Australian Dollars ($AUD) and are inclusive of 10% GST (unless otherwise noted).

Monstees Custom Printing accepts online payment via credit card or debit card. All payments sent electronically shall be securely transmitted using Secure Socket Layer (“SSL”) technology.

Monstees Custom Printing may also accept payment via check or purchase order. Qualified Institutions (such as Purchasing Offices) wishing to establish group accounts and utilize purchase orders may set up special payment options by contacting Monstees Custom Printing.

Monstees Custom Printing will begin processing orders immediately upon verification that payment has been received.

Shipment/Delivery Times

Monstees Custom Printing’s orders are generally delivered within 5-15 business days, depending on the Shipping Method chosen. Please see our Shipping Page for the available shipping methods and times.

The delivery times noted are only an average estimation, and some delivery can take longer, or alternatively be delivered much quicker. All delivery estimates given at the time of placing and confirming the order can be subject to change. In any case, we will do our best to contact you and advise you of all changes. We try our best to make Product delivery as simple as possible.

Customers who are concerned about meeting deadlines should contact us. Rush orders (subject to availability) are available for a 25% rush charge. Rush orders are delivered within 3 to 6 business days.

Returns Policy

Monstees Custom Printing goes to great lengths to ensure that all orders are filled accurately and on time and are of the highest quality. Accordingly, Monstees Custom Printing accepts returns and will refund the payment if and when customers are disappointed by Monstees Custom Printing merchandise for one of the following reasons: (a) the blank items themselves are materially flawed; (b) the quality of the decorating (i.e., the printing quality) is below a reasonable range of expectations; or (c) the design of the final product is materially different from the final design submitted by the customer.

Colour Matching

Monstees Custom Printing strives to provide the best possible prints; however, we can not guarantee Pantone colour matching or exact colour matching with all designs. Colours may vary due to inks, design files, garment colours and fabrics.

Print Placement

While printing, we do our best to ensure designs are printed in consistent locations on all shirts in the run. However, small variations should be expected. All garments are sewn differently, and variations in each individual shirt may result in slightly varied placements.

A 0-7cm″ vertical allowance, and 0-2.5cm horizontal allowance, in the proofed location, is considered acceptable.

If the desired print location is near a seam or a collar, these variances may be more noticeable. Monstees Custom Printing will not be responsible for print location variances the allowances.

Garment Sizing

Please refer to the product page’s sizing chart for information and measurement guides.

The charts provided are of garments laid flat. Monstees Custom Printing follows industry practice on standard tolerances. Please allow 25mm tolerance/variation for AS Colour garments and up to 30mm for Sportage garments.

Limit of Monstees Custom Printing’s Responsibility

Monstees Custom Printing will be responsible for acting only on those instructions sent to Monstees Custom Printing that actually are received and does not assume responsibility for malfunctions in communications facilities not under its control that may affect the accuracy or timeliness of any orders you send. Monstees Custom Printing is not responsible for any losses or delays in transmission of orders arising out of the use of any Internet Access Service Provider or caused by any browser software or any computer virus or related problem that may be attributable to services provided by any Internet Access Service Provider. Monstees Custom Printing is not responsible should you give incorrect instructions or if your credit-card payment is not processed by your credit card company.

The information and materials contained in this Site, including text, graphics, links or other items, are provided “as is”, “as available”. Monstees Custom Printing does not warrant the accuracy, adequacy or completeness of the information and materials on the Site and expressly disclaims liability for errors or omissions in this information and materials. No warranty of any kind, implied, express or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose or freedom from computer virus, is given in conjunction with the information and materials.

In no event will Monstees Custom Printing be liable for any damages, including without limitation, direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Monstees Custom Printing, or representatives thereof, are advised of the possibility of such damages, losses or expenses.

Indemnity
You agree to defend, indemnify and hold Monstees Custom Printing and its affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys’ fees, arising from or relating to your use of Monstees Custom Printing’s Site and the Service, your violation of this Agreement, or your violation of any rights of another.

Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Australia.

For your protection, you will be required to provide proof of your identity to obtain a copy of your Personal Information. If your Personal Information changes or if you no longer want to use the Monstees Custom Printing Services, you may correct, update or deactivate your Personal Information and/or your account through the account management screen. If you would like to deactivate or terminate your account you can also contact our Customer Service.

 

Tell-A-Friend

If you choose to use our referral service to tell a friend about the Website, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Website. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program.

 

Security

The security of your Personal Information is important to us. When you enter sensitive information such as a credit card number and/or social security number on our registration or order forms, we encrypt that information using secure socket layer technology (SSL). Under Thirteen. The Website and the System are intended for users aged 13 and older only. In addition, we will delete any information in our database that we know originates from a child under the age of 13. Thirteen to Seventeen. Prospective users between the ages of 13 and 17 can only use the Website under their parent’s or legal guardian’s supervision.
